Likelihood of Confusion

Trademarks so similar and the goods and/or services for which the marks are used are so related that consumers would mistakenly believe the marks come from the same source.

Search federal registrations, state registrations, and “common law” unregistered trademarks.

Considerations include:

  • similarities and differences;
  • marks do not have to be identical;
  • sound, appearance and/or meaning; and
  • relatedness of the goods and/or services.
